El proyecto de ley que el Gobierno presentó hace un mes para conceder a los malos conductores la amnistía de sus multas, incluso las que califican como “muy graves”, espera a ser debatido en la Comisión de Transportes y Comunicaciones del Congreso.
Durante este tiempo, el Ministerio de Transportes y Comunicaciones (MTC) ha intentado aclarar ante la prensa que “no va amnistiar las multas vinculadas a la seguridad vial”, como aquellas por manejar ebrio o sin brevete. Sin embargo, la campaña #NoTePases de El Comercio hizo un cruce entre las multas que no se van a perdonar con todas las del reglamento de tránsito.
El resultado es preocupante: aquellas que se busca amnistiar son exactamente las que registran las combis piratas y taxis colectivos, que operan con prácticas que bordean la ilegalidad. Eso explica por qué este proyecto fue uno de los pedidos del gremio de transporte informal para dejar de acatar el paro en abril.
INFRACTORES PREMIADOS
De aprobarse esta propuesta legislativa -firmada por Pedro Castillo y Anibal Torres- entre las multas que podrían ser “perdonadas” figuran la M-10 (abastecer de combustible un vehículo de transporte público con personas a bordo), G-47 (estacionar afectando la fluidez del tránsito) y la G-61 (no llevar las placas de rodaje en el lugar que corresponde).
El Comercio identificó que todas estas infracciones son cometidas, en su mayoría, por colectiveros informales y conductores de combis. En el caso del reglamento de transporte de carga, se busca amnistiar incluso la multa U-16, por agredir a un inspector.
Así, con malos choferes a bordo y vehículos en mal estado y sin regulación, la vida de las personas queda totalmente desprotegida, tal como lo señala Luis Quispe, presidente de la ONG Luz Ámbar. El especialista consideró que es “una decisión muy delicada y grave” que el Ministerio de Transportes y Comunicaciones está dejando pasar por alto.
“A lo que está llevando esa norma es a que los conductores en lugar de modificar su conducta [para bien], el efecto sea contrario. Ahora los conductores incurrirán en infracciones y pondrán en mayor peligro a los usuarios, tanto a pasajeros como peatones. Es una cosa incomprensible lo que viene haciendo el MTC. No solamente está promoviendo la informalidad, está poniendo en peligro la vida de las personas”, aseveró a este Diario.
Similar opinión tuvo el coronel PNP (r) Franklin Barreto, exjefe de la Unidad de Investigación de Accidentes de Tránsito de la Policía, quien además consideró que cualquier tipo de condonación es mala y negativa porque deja un mal precedente.
“Toda condonación o amnistía es un despropósito. En una sociedad en la que la educación vial no ha sido tomada en cuenta, esto va a ocasionar que simplemente las personas digan ‘vamos a esperar a la siguiente amnistía’. Se va a generar un efectivo contrario a lo que se pretende solucionar”, señaló.
Días antes de que se diera a conocer la propuesta legislativa, el presidente Pedro Castillo había señalado en Huancayo que “tenemos que ser un Gobierno que atienda las necesidades del país”. Las declaraciones las dio en medio del paro de transportistas.
¿Pero fue un mensaje con convicción? Según registros de la Policía Nacional del Perú de los que ha tomado conocimiento la Defensoría del Pueblo, en el 2021 se produjeron cerca de 75.000 accidentes de tránsito.
Con la aprobación de este proyecto, por ejemplo, la combi de placa C1Q-372 que fue perseguida en El Agustino luego de que su conductor atropellara a una inspectora de la ATU sería exonerada del pago de S/4,493.28 de multa.
De igual manera, el vehículo del peor conductor de Lima, según identificó El Comercio hace unos años, sería eximido del pago de S/1,350.80 de multa. Este chofer de nombre Alberto Villarreal Tasayco ha sido sancionado al menos 48 veces con multas que ahora el MTC pretende que sean amnistiadas, entre ellas, la G47, G58, L01, L05, l07 y más.
Estas multas también se repiten en los vehículos de placas ARX-783, C2E-759, H1U-707, A0J-777, A8U-758, todos ellos protagonistas de accidentes de tránsito en los últimos cuatro años.
Por todo esto, la Defensoría ha solicitado al Congreso el archivo definitivo de esta propuesta. Gloria Montoya, representante de la Adjuntía para los Servicios Públicos de dicha entidad, indicó a este Diario que “realmente no contribuye con la seguridad vial ni con el cumplimiento de las normas de tránsito”.
“Nos parece inaceptable. Es un trabajo arduo el que ejecuta la Policía, los inspectores, las autoridades en general para hacer cumplir las normas y sancionar las infracciones. Que todo eso se vea borrado de un plumazo solo porque así lo dispondría una ley nos parece absurdo y una burla a las víctimas de accidentes de tránsito que se producen justamente en su mayoría por la imprudencia del conductor”, declaró.
Asimismo, Lino de la Barrera, extitular de la Dirección de Transporte Terrestre del MTC, consideró que “es un proyecto a la medida de la negociación que estaban haciendo” con los transportistas. “Este proyecto es consecuencia de una negociación, donde se ha usado como moneda de cambio las infracciones para detener una situación de paro que no sabían cómo controlar. Se trata de un proyecto donde no ha existido ninguna lógica al momento de acumular las infracciones que han metido en ese paquete”, indicó.
