CONGRESO APROBÓ LEY DE COMPENSACIÓN DE HORAS NO TRABAJADAS DURANTE PANDEMIA

El Pleno del Congreso aprobó por 100 votos a favor, tres en contra y dos abstenciones el texto sustitutorio del Proyecto de Ley N° 1097/2021-CR. Esta ley dispone medidas para garantizar los derechos de los trabajadores afectados por las disposiciones legales implementadas durante la emergencia sanitaria provocada por la Covid-19. La propuesta también fue exonerada de segunda votación.

En concreto, la medida busca facilitarle a los trabajadores del sector público y privado la compensación de las horas dejadas de trabajar debido a la licencia con goce de haber dispuesta por la emergencia sanitaria, principalmente a los grupos de riesgo.

A detalle, la ahora autógrafa propone que las horas acumuladas de licencia con goce de haber, sean compensadas con sobretiempo antes o después de la jornada de trabajo, siempre y cuando la suma de dichas horas con la jornada laboral del trabajador, no supere las 52 horas semanales. También se podrá considerar las vacaciones adquiridas y pendientes de goce, con el límite de 15 días por periodo vacacional y capacitaciones fuera de la jornada de trabajo.

Así, se establece que la compensación se dé en una equivalencia de 1 a 3. Es decir, cada hora de trabajo en sobretiempo o dedicada a las capacitaciones fuera de la jornada, compensará tres horas de licencia con goce de haber. Igualmente, cada día de vacaciones equivaldrá a tres días de licencia con goce de haber.

Según sostuvo la presidenta de la Comisión de Trabajo, Sigrid Bazán, la compensación culminaría en un plazo de un año.

“Está prohibido realizar descuentos en la liquidación de beneficios sociales realizada al término del vínculo laboral, para compensar las horas de licencia con goce de haber generadas por las disposiciones legales implementadas en el marco de la emergencia sanitaria por COVID-19″, se lee en el documento legislativo.

Bazán, presidenta indicó que la población de riesgo, entre ellos los mayores de 60 años y quienes tuviesen comorbilidades, han acumulado deudas por hasta 4.000 horas de licencia sujeta a compensación.

“Se ha generado una problemática social en donde los trabajadores pertenecientes al grupo de riesgo han acumulado una gran cantidad de horas que son prácticamente imposibles de pagar y se corre el riesgo de que sean sometidos a jornadas extenuantes de hasta 12 horas o que se les realizasen descuentos sobre sus remuneraciones, beneficios sociales o liquidaciones”, argumentó.

En ese sentido, destacó que estos hechos representaban una vulneración a los derechos a la vida, a la salud y a la dignidad del trabajador.

Durante el debate, la congresista Patricia Suárez de Fuerza Popular presentó una cuestión previa para que el texto regrese a comisión; sin embargo, esta fue rechazada por la representación nacional.

La autógrafa ahora deberá ser evaluada por el Ejecutivo para su posterior promulgación u observación en un plazo máximo de 15 días.
