El expresidente del Tribunal Constitucional Óscar Urviola, abogado que está defendiendo la causa que ha planteado la candidata presidencial Keiko Fujimori, cuestionó el plazo establecido por el Jurado Nacional de Elecciones para la presentación de pedidos de nulidad luego de que el propio el organismo electoral dejara sin efecto su ampliación.
El abogado precisó que su función en el proceso legal que ha planteado Fuerza Popular se limita a lograr que el Jurado Nacional de Elecciones garantice que los resultados de las elecciones «sean el fiel reflejo de la voluntad popular». Para esto, insistió en que se respete el horario de ampliación para recibir apelaciones.
El exmagistrado del Tribunal Constitucional recordó que en febrero de este año la ONPE dictó una resolución que establecía la mesa de partes presencial y virtual con un horario de atención hasta las 23:59 horas para todo el proceso electoral. Por otro lado, señaló que la propia Constitución establece que los organismos electorales actúen «de manera coordinada».
«Si la ONPE establece un horario, yo creo que ha habido en este caso una actuación del JNE de no establecer las mismas facilidades para poder lograr el objetivo que estos tres organismos están obligados a hacer (…) Hay actos que no necesariamente tienen que estar expresado en resoluciones, este es un acuerdo del Pleno del JNE que se hizo conocer», cuestionó.
