Cuando los hijos van creciendo y sus necesidades aumentan, los gastos también se incrementan, y sumado a la mejora de la capacidad y economía del obligado, se puede iniciar una demanda solicitando un incremento de pensión de alimentos.
El fundamento legal es el artículo 482 del Código Civil:
Artículo 482.- Incremento o disminución de alimentos
La pensión alimenticia se incrementa o reduce según el aumento o la disminución que experimenten las necesidades del alimentista y las posibilidades del que debe prestarla. Cuando el monto de la pensión se hubiese fijado en un porcentaje de las remuneraciones del obligado, no es necesario nuevo juicio para reajustarla. Dicho reajuste se produce automáticamente según las variaciones de dichas remuneraciones.
